Terms & Conditions of Sale Yeti x Liquid Death Casket Cooler Online Auction

Please Note: All persons participating in this auction (“Auction”) of the YETI x Liquid Death Casket Cooler (the “Casket Cooler”) are responsible to read, understand, and comply with the terms of sale as specified herein and agree to be bound thereby.

Bids: Placing a bid is a binding commitment to purchase the Casket Cooler at the amount bid. 

Eligibility of Bidders: Bidders warrant that they:
- Are over 18 years of age;
- Are not an employee of  YETI Coolers, LLC (“YETI”), Supplying Demand, Inc. (“Liquid Death”), or any of their affiliates;
- Have a delivery address where they can take delivery of the Casket Cooler in the contiguous United States; and
- Are in no way disqualified to participate in the Auction by law, rules, regulations, or policies.

Online Bidding:
- Bidding on the Casket Cooler will take place online at liquiddeath.com/YETI.
- The Auction will start on August 28, 2024 at 9 am PST, and end on August 30, 2024 at 12 pm PST (subject to revision by Liquid Death).
- Starting bid will be $1500, with a minimum bid increment of $20, and a maximum bid increment of $100.

Tie Bid:
In the case of a tie bid, precedence is given to the earliest bid.

Auction Soft Close:
- If a bid is received within the last 1 minute of the Auction, then the Auction will remain open for an additional 5 minutes.
- If any further bidding occurs within the last 1 minute, the extension timer will extend by 5 minutes; provided that no additional time will be added after 1:00 pm PST.
- If no further bidding activity occurs, the lot closes when the timer runs out. Bidders are urged and cautioned not to wait until the final seconds of the auction to place bids. Bids not recognized by the auction software when the time expires will not be accepted.
- Note: If a bid is recognized by the auction software during the final seconds, the screen may display "00.00" in time left. It can take several seconds for the clock to reset, possibly longer. The bid will trigger an extension on the lot and 5 minutes will be added; provided that no additional time will be added after 1:00 pm PST.

Post Auction Steps: Following are the basic steps following the close of the Auction.
1) High-bid email sent to relevant bidder.
2) Final payment email with instructions, documentation request, and payment link sent to Buyer.
3) Buyer to complete all requests of Liquid Death and make final payment via credit card, bank wire, or ACH transfer, only, within 48 hours of email notice. If payment is not received, then Liquid Death will start over at step (1) with the next highest bidder.
4) Payment receipt emailed to Buyer by Liquid Death, and Buyer will be put in touch with YETI to coordinate delivery from YETI within the contiguous United States.
5) Buyer arranges with YETI for delivery.

Payment Forms: Acceptable forms of payment are credit card, bank wire, and ACH, in each case in Liquid Death’s sole discretion. VISA, MASTERCARD, AMERICAN EXPRESS and DISCOVER credit cards are accepted. U.S. funds only. Cashier’s checks, personal checks, bank letters, debit cards or letters of credit are not accepted. ALL CREDIT CARD RECEIPTS MUST BE IN THE NAME OF THE WINNING BIDDER. Credit cards issued to Buyer’s spouse will not be accepted for use by the Buyer for payment. Any wire transfer or ACH fees are the responsibility of Buyer.

Refunds: Liquid Death makes no refunds, adjustments, or returns. All purchases are final (See No Warranties below).

State Sales Tax: Buyers are responsible for all applicable sales tax. For information on taxes, check with the appropriate state franchise tax board.

No Warranties:
The Buyer understands and agrees; (1) that any description or sample of the Casket Cooler given or furnished by YETI or Liquid Death is solely for identification, and DOES NOT CREATE ANY WARRANTY, expressed or implied, that the Casket Cooler actually conforms to such description or sample; (2) all weights, measurements, and descriptions must be considered approximations and do not create any warranty; and (3) that the Casket Cooler is purchased and accepted by buyer "AS IS, WHERE IS" and "WITH ALL FAULTS."
NEITHER YETI NOR LIQUID DEATH MAKE ANY WARRANTIES OR GUARANTEES WHATSOEVER WHETHER WRITTEN, ORAL, OR IMPLIED AS TO QUALITY, QUANTITY, CONDITION, USABILITY, SALABILITY, WEIGHT, MEASUREMENTS, OR OTHER SPECIFICATIONS. Sale of Casket Cooler will not be canceled due to bidder misunderstanding or failure to pay attention to the bidding. All sales are final. Without limiting the foregoing, the Casket Cooler is for use with packaged food and beverages, only.

Liquid Death will make the final determination regarding all inquiries/disputes. The amount of any recovery is limited to and not to exceed, the purchase price of the Casket Cooler. Buyer is not entitled to any payment for loss of profit or any other money damages, including special, direct, indirect, incidental, or consequential.

Shipping: Shipping will be coordinated between Buyer and YETI, with such documentation and conditions as YETI shall require, in YETI’s sole discretion. Buyer consents to Liquid Death providing Buyer’s address to YETI in order to coordinate delivery. Buyer agrees to hold harmless YETI or Liquid Death for items lost or damaged if shipped and will pursue any claims with the shipping company.
